Driving Without Insurance in Richmond

Traffic Ticket Lawyers – Over 60 Years of Experience on Your Side

Have you been charged with driving without insurance? Contact our Richmond traffic ticket attorneys at Carlson & Collier to make sure that you protect your future. In the Commonwealth of Virginia, every individual operating a motor vehicle must have auto insurance or pay the uninsured motorist fee. This fee is $500.00 for 12 months.

It is important to be aware that the uninsured motorist fee is not coverage. Should an accident occur for which you are at fault, you are personally responsible for damages and injuries. Not only is driving without insurance illegal, it also puts you in dangerous and vulnerable situation should you get in an accident.

What happens after being charged for driving without insurance?

Anyone driving without insurance or without paying the uninsured motorist fee will face suspension of their:

  • Driver's license
  • Vehicle registration
  • License plates

In order to have your privileges reinstated, you must pay a reinstatement fee, ranging from $145.00 to $220.00. You will also be required to pay a $500.00 fine as well as filing and maintaining proof of insurance (SR22) for 3 years, which will make your insurance premium higher. Please note that SR22 is not insurance and car insurance must be purchased.

After a conviction for driving without insurance you will not be eligible to pay the uninsured motorist fee. You will need to maintain car insurance without a secondary option. These stipulations are detailed under Code of Virginia § 46.2-705, § 46.2-706, and § 46.2-707. You should also seek the assistance of an experienced Richmond criminal defense attorney as soon as you can to help fight your charges.
