What's the difference between voluntary & involuntary manslaughter?

There are two types of manslaughter in Virginia: voluntary and involuntary.

  • Voluntary manslaughter is charged when a death occurs during the heat of the moment, in self-defense, or while committing another felony. The defense must prove there were mitigating circumstances that contributed to the accused individual's actions. For instance, was the defendant scared for his / her own life, but perhaps went too far by taking the other person's life?
  • Involuntary manslaughter occurs when the crime was committed without intent or malice. Criminal negligence may be involved or the accused may have been in the process of committing another crime, other than a felony or murder. An example of this would be reckless driving. If not for the fact the accused was driving recklessly, the death would not have occurred. By driving recklessly, the defendant knew that someone could be harmed, although they did not intend to hurt that person.

Both voluntary and involuntary manslaughter are considered Class 5 felonies in Richmond, Virginia via the Commonwealth of Virginia law. The punishment for a Class 5 felony is imprisonment for not less than 1 year and not more than 10 years. The court may, however, decide on jail time of not more than one year and a fine of $2,500, either or both. This is detailed under the Code of Virginia Sections 18.2-30-36 and 18.2-10.
